Jose Ortega quietly cried Monday as he signed the papers that would send him to prison for the next 40 years. Although he briefly hesitated in front of the judge, Ortega, 28, pleaded guilty to shooting a handgun at Lubbock police officers who were attempting to serve a felony warrant last September. Prosecutor Barron Slack said the officers tried unsuccessfully to use a stun gun on a resisting Ortega. The fight went to the ground, where Ortega fired a shot near Officer Gerardo Torres' head.

Alleged rape victim accused of fabricating story 05/11/11 - 1:29am

courts/Attorney says woman made up allegations to avoid military service

The attorney of a man charged with raping his stepdaughter accused the alleged victim Tuesday of concocting the allegations to get out of military service. David Moreno, 55, is on trial charged with two counts of aggravated sexual assault against his stepdaughter. Moreno’s attorney, Travis Ware, insinuated multiple times that the woman, now 27, fabricated the story. At one point Ware posited that “lots of women are using Post Traumatic Stress Disorder and sexual assault allegations to gain early military discharge.

McKinney found not guilty of DWI 04/29/11 - 6:25pm

A Lubbock County jury this evening acquited Justin McKinney after deliberating more than an hour. McKinney was found not guilty of driving while intoxicated on April 27, 2009. He was involved in a head-on collision that killed Lubbock Sheriff's Cpl. D. Robert Harvey. For more on this story, read Saturday's A-J.

McKinney DWI trial postponed until next week 04/27/11 - 11:07am

A Lubbock County judge this morning postponed the trial of Justin McKinney until next week after McKinney's attorney failed to comply with a court order. McKinney is on trial for driving while intoxicated. He was arrested after being involved in a head-on collision that killed a Sheriff's deputy in 2009. An accident reconstructionist was scheduled to testify this morning, but Bill Wischkaemper, McKinney's attorney, failed to provide prosecutors with required materials related to the witnesses expert testimony.

LPD officer cleared in February shooting death 04/12/11 - 6:39pm

A grand jury investigation today cleared of any wrongdoing a Lubbock police officer who shot and killed a man in the line of duty earlier this year. Jennifer Breazeale will not face any charges for the shooting death of 25-year-old Jermar McKinzie. Breazeale killed McKinzie when the officer responded to a domestic dispute between McKinzie and his girlfriend, 20-year-old Zitra Rivera, at about 4:30 a.m. February 20. McKinzie was holding a knife over Rivera’s throat as if he was about to stab her.

Arredondo gets 10-year sentence in connection with 2008 shooting 04/07/11 - 11:45am

Christopher Arredondo today pleaded guilty to aggravated robbery and received a 10-year prison sentence. Arredondo pleaded guilty to a 2008 incident at the Cora Apartments, in which his co-defendant, Matthew Gonzales, received 70 years in prison for shooting a man while the two burglarized a vehicle. Man pleads guilty to driving drunk, nearly killing deputy 04/07/11 - 11:35am

Antonio Aleman pleaded guilty this morning to aggravated assault for the drunken driving wreck that severely injured a Sheriff's Office deputy in May of last year. Aleman agreed to a 17-year prison sentence for hitting Cpl. Scott Duncan head-on with his vehicle on FM 1585. In addition to the aggravated assault, Aleman's probation was revoked and he was sentenced to 10 years in prison for his third Driving While Intoxicated charge, for which he was on probation when he struck Duncan. Aldawsari trial reset for October 04/06/11 - 10:43am

A federal judge on Tuesday issued an order resetting for October the trial date for a Saudi national accused of plotting attacks on U.S. targets. The trial for Khalid Ali-M Aldawsari was moved from its original May 2 date to October 24 to give attorneys adequate time to prepare. For more on this story, read Thursday's A-J.

Aldawsari pleads not guilty, case set for trial 03/28/11 - 2:40pm

A Saudi national arrested last month on suspicion of plotting attacks against the United States pleaded not guilty Monday in federal court. Khalid Ali-M Aldawsari, 20, declined to have read the indictment in which a grand jury earlier this month charged him with attempted use of a weapon of mass destruction. U.S. Magistrate Nancy Koenig set the case for trial May 2. Aldawsari faces up to life in prison if convicted.

Federal judge sentences man who made bomb threat 03/25/11 - 12:16pm

A federal judge this morning sentenced a man to nearly nine years in prison for mailing threatening letters to the U.S. Attorney General indicating he intended to detonate a bomb and kill Barack Obama. Christopher Oliphant received a 45-month sentence for making a bomb threat and the maximum five years for threatening the president. U.S. District Judge Sam Cummings ordered that the sentences run consecutively, totalling 105 months in prison, followed by three years supervised release.
